1. Overview
These terms and conditions govern your use of the services provided by Optimise Digital (“we”, “us”, “our”), including but not limited to Google Ads management, SEO services, digital marketing consulting, and free audit services. By engaging with our services or submitting a form on our website, you agree to these terms.
2. Free Google Ads Audit
We offer a complimentary Google Ads Waste Finder audit covering up to 13 areas of your Google Ads account. The following conditions apply:
- 3-hour turnaround: The 3-hour delivery guarantee applies to accounts with an average monthly spend of at least $3,000 AUD over the preceding 12 months. Accounts below this threshold will receive their audit within 24 hours of granting access.
- Turnaround start time: The turnaround period begins from the moment we receive valid read-only access to the Google Ads account, not from the time of form submission.
- Business hours: Turnaround times apply during Australian Eastern business hours (Monday to Friday, 9am–6pm AEST/AEDT). Requests received outside of business hours will commence processing on the next business day.
- Read-only access: The audit requires read-only access to your Google Ads account. We will not make any changes to your account, campaigns, or settings during the audit process.
- No obligation: The free audit carries no obligation to engage our paid services. You are free to action the recommendations independently or with another provider.
- Confidentiality: All account data accessed during the audit is treated as confidential and will not be shared with third parties. Anonymised findings may be used for illustrative purposes on our website with identifying details removed.
- One audit per account: The free audit is limited to one per Google Ads account. Repeat audits may be offered at our discretion.
3. Risk-Free 90-Day Growth Guarantee
Our risk-free guarantee promises measurable growth within the first 90 days of active management, or we refund our management fees for that period. The guarantee is offered to qualifying brands only. Qualification is determined by us following a free account and website audit, which lets us assess your current performance, growth potential, and whether measurable results are achievable within 90 days. A brand qualifies when, based on that audit, all of the following conditions are met:
- Minimum ad spend: A committed advertising budget of at least $4,000 AUD per month, maintained for the full 90-day period.
- Conversion tracking: Valid, working conversion tracking is in place (or can be implemented by us) so that growth can be measured accurately and agreed before the period begins.
- Agreed definition of growth: Before the period begins, we must reach a written agreement on what growth means for your account, including a single primary success metric (such as qualified leads, conversions, or revenue), the documented baseline it is measured against, and the reasonable target that defines success. The guarantee applies only to this agreed metric, baseline, and target.
- Reasonable account access: We are granted the access and approvals needed to implement recommendations, including landing page, tracking, and campaign changes, within a reasonable timeframe.
- Stable conditions: The guarantee excludes growth shortfalls caused by factors outside our control, such as website downtime, stock or capacity limits, pricing changes, seasonality outside the agreed baseline, or policy suspensions not caused by us.
- What is refunded: If the agreed success metric is not improved over the documented baseline within 90 days, we refund the management fees paid for that 90-day period. The refund is limited to those management fees and does not include advertising spend paid directly to Google, third-party costs, or any other expenses.
- Reasonable assessment: Whether the agreed growth target was met is assessed reasonably and in good faith using the tracking and reporting agreed at the start. Where results are affected by factors outside our control, or by incomplete or inaccurate data we did not cause, the target and outcome will be reviewed on a reasonable basis.
- Refund timing: Where a valid claim is confirmed, any refund of management fees is processed within 90 days of the claim being agreed.
Final eligibility is determined by us after the audit and confirmed in writing before the engagement begins. We reserve the right to decline the guarantee where, based on the audit, these conditions cannot be met.
4. Google Ads Management Services
Paid management services are governed by a separate service agreement provided prior to engagement. Management fees, scope of work, reporting cadence, and termination terms will be outlined in that agreement. These general terms apply in addition to any specific service agreement.
5. Use of Website & Tools
Our website and free tools (including the SEO Audit, Keyword Tracker, and Conversion Rate Audit) are provided “as is” for informational purposes. While we strive for accuracy, we do not guarantee specific outcomes or results from the use of our tools or recommendations.
6. Privacy & Data
Personal information collected through our forms is used solely for the purpose of delivering the requested service and follow-up communications. We do not sell or share personal data with third parties for marketing purposes. For full details, please refer to our Privacy Policy.
7. Limitation of Liability
To the maximum extent permitted by law, Optimise Digital shall not be liable for any indirect, incidental, or consequential damages arising from the use of our services, tools, or recommendations. Our total liability for any claim shall not exceed the fees paid for the specific service giving rise to the claim.
8. Changes to Terms
We reserve the right to update these terms at any time. Changes will be posted on this page with an updated revision date. Continued use of our services after changes constitutes acceptance of the revised terms.
